Yoz! So now it is time for me new entry. Yeah, i know, it is not even near weekend, then why the hurry? Due to the tremendous(ARH!!! my bad speeling!!!) comments i get on my prev blog post(refer to previous entry if in doubt), i decided it is time for THE MAN to come forward and sort out some stuffs.

Firstly, politics is never my cup of tea(coffee, honey, watever), nor (i will make a generalization here) for the main population(u noe by the number of ppl who actually bothered to watched parliment meetings every month that is aired after the news). So to others(JC students, Uni undergrads), i might be just a part of their dry subject, homework. Nothing good or facinating about it(not like porn). SO WHY ARE WE DWELLING ON THIS TOPIC?!?!?!?! SCARING MY NORMAL READERS OFF!!!(Sorry i couldnt help myself...)

But i will like to add that the situation we have in singapore is uniquely singaporeancanize(if such a word exist, or should i omit the "rean"?) Meaning it is just as "rojak" as most of the things u get here. For example the food here "rojak" together le, language, culture all "rojak" le.(from here onwards, i will use "rojak" as in "mixed up together". not that i actually noe the actual malay meaning). How does this apply to the government here?

Okie, long since before we are born, shortly after WWII, we are just gaining independence from jap/british colonial(i need to go thru grammer sch but u noe wat i mean) rule. That time, we are considered a third world country(that time, living conditions and economic is not as good as now, ya i know, some brits infrastructure still survive during that time but then again...), new in alot of things, and as we all noe, of all things, starting up is the hardest(like the chinese saying goes,"wan shi qi tou nan"). So we used the british system(their english, law, everything) and sort of edit it to suit our needs. For that time, it is sufficent for our needs and thus, nobody complain and singapore progresses.

(afterthought: i would like to add that all these, are started by the leadership of SM LEE KUAN YEW.(wonder wat SM stands for... wait... Senior Minister!(self appointed)) and he saw the nation thru alot of crisis. (haven u attended national education? hmmm vaguely familiar... in the communist setting...) He is good, cause if he just do one wrong move, or do something according to his own wimps, the nation wouldnt be as good as we are now. Just look at all the nation that gain independence recently. Big or small, newly started or not, none of them attained to the efficency we have in this nation.(dont compare with US, Brits, China, or Jap, they are independent frm day 1, even some who are independent for a long time cant match up to us.) So this SM LEE is indeed respectable since he did so much for the nation within his one lifetime(but the credit is not solely his, he is more prominent, thats all. i think it has everything to do with his face. hahahaha his family all got unny faces. ). Some countries need a few good leaders(a few lifetimes) in order to get to their current state. Point to note: i come across this when reading his(SM LEE) autobiography. It goes: "Even if this is a nanny state, i am proud to have fathered one." Good stuff. Be proud of ur mistake. Learn from him. I hereby salute him. *SALUTE*)

So wat i have said previously, there are using rulings and such frm then, when we are a third world country, and still using it on us, when we have already progress to be among the first world nation. Wat does this means? Using third world rules and regulations to govern a first world country lor! Isnt this good? B*lls to u! F*ck u, understand? This is no good at all. U see, its like using communism(to me, it is a seriously warped third world type of government, i wonder why all communist country are stuck at being third world...) on the US. U see wat i mean? Cause as the population gets more and more educated, they start to noe wat it out there in the world(like porn). When they noe wats out there(free porn, no bans), they start to compare(why singapore ban porn???). And after they compare, they start to request for good things that they dont have(we want porn!). Simple? And for our law system, it is already outdated. We should use a jury system here and remove the "death by hanging" for muderers, life imprisonment for manslaughter(but death for druggies, i support that, or drugs will be a society problem).

Why jury? Once upon a time, after we gain independence, we do have the jury system. But there was this incident where some chinese hacked a malay(or vice versa) in a racial riot, regarding some girl whose parents are not her real parents(i forgot about the case le lar). And SM LEE then was a lawyer helping the defendant(that is, those murderers). He noe that those defendants really did murder someone but due to his laywer ethics(or so he says), he managed to get them aquitted, that is, those murderers are released without punishment. He did this my moving the jury(no, he didnt threaten to move them into jail or wat so ever, he not PM yet mah). So his conculsion after this case is to do away with that system once he comes into power. But remember ppl, this period is "early singapore" period, where we are still considered as 3rd world. Where riots, crimes happen more often then now,(nowadays, the onli riots are flash riots. kuku riots that are created by the well fed, nothing to do singaporeans. just one yr or so back, someone posted on the net to gather a number of working adults to do some funny things on the escalator in raffles mrt station. so they gathered abt 10+ ppl, and used the escalators(to go up and down la, no they didnt do crude things to it)) 20 odd times. not that alot of ppl notice it anyway. NO POINT!) and then, ppl are not as educated as we are now. Back then, the jury might be votting for which laywer had a better performance. SM LEE(with his funny face, erh... head) came up with a better performance and so he won. Or maybe back then, ppl are more supersitious and they dont want to send a man to the gallows. They might think that thus they will taint their hands.

But now, with the majority educated(due to the law that states every one who attain the age of 6, are to attend primary school), jury system are fairer than wat we have now. Rite now, wat ever u do, are judge by one guy onli... (I rather be judged by a pool of "fellow citizens".) And since singapore is a country where the population are scared to do the wrong things(no balls country), that one guy(the judge lar!) are oso prone to it. So wat that guy do? He refer to past judgement that are similar to the current case and judge accordingly. So wat does he has? He has a "shield". If somebody says he is wrong, then he says back then, that judge oso did the same things, fault him too(that judge he quoted might be long under six feet...) lar. BACK THEN, POLICE WEAR SHORT PANTS!!!!! You start to see wat i mean? We are progressing economically wise, educationally wise but the rest? Are we to say that singapore is a forward seeking country, lead by a backward government? Quit all those bans and such(piracy are legit bans. we need to empasize on it to look good to other countries. this i noe, not that i support orginal. but why ban original porn???!!!!)! Since now the population are educated, we noe how to think for ourselves!!! If all these are not changed, singapore will never be a gracious state. Ever. Even after SM LEE grandson died.(of course, then his grandson will be PM lar)

Death penalty for muders, life imprisonment without pardon for manslaugther, all these are too harsh for a first world state. Why? When we were a third world country, these are nessesary in order to keep the population in check. Back then, ppl are not as educated, more "rough", and might just kill someone in the fit of anger. So we need to scare them that if u kill, u die in return. Maybe its because chinese are more conservative(something to do with chinese thinking) and so we find it right to kill someone if that someone murdered another someone(complicated....) Now? We can provide counselling, therapy for murderers to guide them to the right path. Wat? U say those dont work? Are u questioning their effectiveness? Then why bother to counsel students, workers and such?

Life without pardon for manslaughter. Hmmm... U see, sometimes things just happens. Like if i am using a nail gun, happily nailing my plank of wood, then someone just happens to past by my nail gun line of sight, and my nail gun just happens to misfire and shoot one nail into his heart, wat happen? That guy died, i get locked up(for life, mind u) for being "suay". In this sort of situation, normally ppl dont think tat u are innocent. How come nail gun so "heng", one shot die? Counterstrike oso not as "heng". Then wat can the "shooter" do? "Lan Lan Suck Thumb".

About death for druggies, i support it, but with strong evidence backing. Why did i say so? Once there was a case that happens here in changi airport. The date and year it happened, i forgot le. It goes something like this. Once, there is this young teenage girl just back from holiday(or something) and she is just waiting to go through the check point. As she is waiting her turn, one sweet lady(how sweet i am not sure) approached her and said:" do u mind carrying this bag over the check point for me? i need to go to the loo. i will meet u there later. :)" So wat did this nice young lady do? She carry for her lor. Just as this young lady was going through the checkpoint, the police stopped her, checked her belongings(and that bag), and found drugs in it. So who kena? The nice girl kena. Then wat that nice girl say? "Not my one, its a lady's one." Who believe her? Then when she was asked to identify that lady, that lady long gone le, where got stay and watch show? So wat happens for this young lady? She cry and cry, kept saying not hers(like any girl who are caught with this sort of stuff) and stuff like tat but then she was hanged soon after. Innocent or not? I am not sure but these sort of things happen. This is how come ur mum kept reminding u not to take parcels or bags or stuffs from ppl u dont noe. So this girl died because she too good, too stupid and too "suay".

With all the bans, system we have here, i think it is time we give them a proper reveiw and change them to suit our current needs. HELLO?!?!?! WE HAVE PROGRESSED, HAVENT WE????? SO CHANGE FOR THE BETTER!!! Wats wrong if someone wants to cut his pubic hair in public? He can jolly well get naked for all i care. Who reported him? Ungracious singaporean! Making alot of noise over stupid little things. Thats singaporean for u, if u havent already noe.(their traits is to make a big fuss out of everything. this is especially prominent in the age groups our mothers belonged to. Oh ya, happens for gals onli too. They can go "wah" over every single thing... sad cases... must be thier sad lifes, washing clothes, looking after "heartless" children, not getting f*cked enuff, lazy to work, so wat do we have? Those ppl we call "kia su ah soh". Damn, must be because of these "kia su ah soh", thats why we still nanny state. "kia su ah soh" can never think for themselves, keeps getting conned by con artist even when the news are showcasing those con artist.... DIE! STUPID KIA SU AH SOH!!!!)

About voting for PM, it happen before mah. We voted for PM Goh le. But back then, it was like a sham. They give u PM Goh, and a fat prick to choose from. That fat prick didnt even bothered to do advertising(maybe the PAP had a hand in this), how can he take on responsibility? It was like :" Hey vote for me if u think that PAP really stands for Pay And Pay." Yes, we hate PAP to a certain extend(i hate their logo...) but how can we afford to vote for that fat prick? At the end, that fat prick will be PM, but onli a puppet. SM still has some say. So i am really worried wat will happen if SM passed away. Will he go heaven? Nope sorry, i am not worried abt that, i am worried abt wat singapore will be after he is gone. Lets face it, SM is old le. Might be going these few years.

So much for our government. Seng, do take all this blog, edit it, correct speeling error, grammer error, omit the crude part, and send it to the DDP or watever that head judge it called. Then CC to SM LEE and his sons(and grandson). Oh ya, i cant hurt if u send it to PM GOH and his sons. Let them learn early. I really hope to see the jury system here started in singapore, at least during my life time. Then i can be the first jury consultant and earn money by helping murderers.

As for the rest of the general readers(those who never post comments b4), this issue is too deep for u. I am glad u survived till here. Go figure. We damn piss now... Wasted my whole afternoon typing this... Work stocked up like stockpiles... Watever. Seng here again. Lolx. I will drop by here to check out any new stuff whenever I log on. I really hope that you would post new entry EVERYDAY. I rather read your blog than read the local tabloid. No choice, holiday now and can't find part-time. Today I just wanna address the issue on the state of the legal system of Singapore. Lolx. It's boring, yeah, but just to clear up some misconceptions. Don't quote me though, I am not writing this comment with treatises and books on law around me. Just from what I can remember. Ah-ga ah-ga la...

First, you say that a jury system is fairer. You say we should adopt a jury system because modern Singaporeans are more educated hence they can make a more informed choice. But we should bear in mind that highly educated does not equate to legally trained. A thing about a jury system is that jurors tend to find it difficult to relate to convoluted and highly technical legal doctrines. It hinders the judicial process and causes backlog.

As you have said, a jury system can be easily manipulated by aggressive emotional attacks by lawyers. I think the judgments of the jurors will be affected in such unfair play of emotion.

Secondly, both a jury system and a judge system depend on previous cases known as precedents to decide current cases. Lawyers in USA and UK which use the jury system still present precedents to the jurors to help them decide on the current cases. This is the case here in Singapore where lawyers present precedents to the judges to help them make their decisions.

Also judges and jurors are not obliged to apply a particular law regardless of the current socio-economic situation. They are free to overrule previous laws and make amendments to them to accomodate novel situations.

As to the death penalty, I am all for it!!! Haa.. Simple reason. I believe an eye for an eye. Call me uncivilised if you want to, I don't care. Just my personal preference to deal with hardcore and recalcitrant criminals. Lolx. Good for providing a deterrent effect too. ^^

Finally, we do not call the accidental causing of death manslaughter. In Singapore, we have a few provisions in the Penal Code to deal with such cases. Depending on how reckless or negligent one was in the causing of death, the sentence will vary of course. In your example of the man with a mis-fired nail gun, I would think that he would not be guilty and could be acquited if he could prove that he, in fact, took reasonable care in using the gun and therefore the death was purely accidental with no fault on his part. Finding of fault largely depends on the presence of a mental element (mens rea) to commit a crime, accompanied by the physical element (actus reus) that constitutes the action. So the lack of one element normally (emphasis added) does not constitute a criminal act.

As to ungracious Singaporeans (side-track a bit), man, this is nothing new. Particularly I can't stand those sanctimonious people, always appearing self-righteous and saying that chewing gum is bad and porn is immoral. At the end of the day, they are the ones hiding away in front of the computers and pleasure themselves. The next morning, they go around proclaiming how harmful and evil porn is and such. Think most Singaporeans are like that. Makes me puke. =p

Singaporean Society deems porn a demerit good - thus, porn is bad. In other words, porn is bad here because the large majority of Singaporeans think that it'll have a negative effect on our society as a whole.

Whether this thought is founded or not is another issue. I think many Singaporeans have been brought up in conservative traditional families where wearing a skirt which has a hemline above your knees is *gasp!shock!* material already - exposing them to nudity would probably result in a cerebral concussion so severe the nosebleed wouldn't stop for weeks...

but I digress. What I'm trying to say is - this mode of thinking is outdated - way past its time. Perhaps this prudish mindset may have served our grandparents well, in the days where there was no Internet (Free Porn for All! Click here to subscribe to our list!), and prevented the general population from the Dire Consequences of Looking At What Is Bad For You. Yet, look at today. Straight / Simple Pornography is available at the touch of a button. People with more... ah, shall we say exotic tastes only need to do a bit more to satisfy their craving.

Since it's so easily available - why not just legalise it here? I'm not talking about R(A) movies. Singaporeans are going to look at it anyway - legalisation would allow the government some means of regulation (and remove some of the social stigma from pornography - after all, you're not evil if you have naughty thoughts once in a while). You can even make a tidy profit off it - last I checked pornography is still the most profitable industry online by a far margin.

Lastly, a pet peeve - strange porn aside, what is wrong with enjoying what is natural? I mean, nudity is mankind's natural state (you aren't BORN with clothes, are you?), and the act of copulation is necessary for species survival. Making it inacessible may only lead to negative outcomes as curious, ignorant people try to "find out more" in the wrong ways...

Seng here. Tahara, you are damn right. I just do not understand this excessive prudishness exhibited by the general public. I do not see how morality and decency can be properly maintained by exercising such draconian policy on pornography. Tahara hit the nail! When pornography is so pervasive and easily available, trying to blindfold the people is not the way. I would think education will provide a moderate brake and prevent the manifestation of a really decadent society. Pornography and education go together.

My god... OMG... By far, this is the best comments i have gotten for my blog issues. Thank you both for giving such insightful comments. There are at least one or two points covered by tahara or seng that i didnt touch on nor thought of. I am greatly impressed, greatly honoured to have a future laywer(seng, notice his discussion on the jury system, he is a law undergrad now) and a rjc old boy, who is going to be wat i couldnt be, a Computer Enginner(and this is tahara, as u can see from his level of english and the way he puts forth his points. way beyond wat i am capable of.)

So having both of u commenting of the jury system and the porn situation here, it rounded up my blog nicely. So nothing more could be said by me or it will spoil the whole thing. But i will still like to add, i find porn an art. Just look at all the positions, ways, methods they used to have sex. I wager none of the other fields(jobs, hobbies, recreation) is as creative as that, and they dont provide THAT same amount of pleasure.

PS: Actually i am thinking that even if onli the two of u(tahara and seng) are to post comments here, this will be quite a "powerful" blog le. I don't think jury systems will work in here lor.. for several simple reasons... singapore's population is not big enough to support an even sampling of people... furthermore you still need to consider the fact that there is a still a significant proportion of pple who do not understand english or are not proficient in the language... and translations when someone's life is involved is no damn joke la... thirdly... it might incite the complaint of racism... when some ethnic groups are represented in larger number than others on the jury... and having equal numbers of the races is more difficult considering the stats anyway...

death penalty is deserved la... if not then got vigilantes sui sui wanna hack someone then go and hack.. hack wrong you still back to square one... so might as well the courts do something about it... but ok la... given... there will be cases whereby the wrong people are penalised for something that isn't their fault... but which would you prefer??? You hack nine guys who deserve to die and accidently hack one who didn't or don't hack anyone and then got nine more people walking along the roads hacking who they choose where they choose when they choose...

forgive lousy lang and incoherence... tired after a long day...

Hmmm interesting comment by an anonymous. Hahahaha do give me some other perspective to ponder.

Firstly, bad lang(and foul lauguages) is condone here. Initially this site was made to promote Singlish(one of the few precious heritage we have left) and yours sincerely isnt that great either.(u see, strange sentence construction but who cares?)

About sampling of the population, frankly, i think the population here is enuff. Just u think, if this is not enuff, then how come so many ppl voted? Interestingly, they got their jury list from registered voters(frm wat i gathered frm john grisham books anyway, seng do correct me if i am wrong) and alot of ppl do vote here. At least the percentage of registed voters against general population here is higher than US, i reckon. And u might counter to say that by volunteering, their army alot more than the conscripted one here but i dont think thats not a real issue as we wouldnt have as much of cases as they have over there.

And about u saying that they are a significant number here who are not proficent in english or just dont understand it. I beg to differ. Those ppl who just dont understand it are mostly not locals. And proficency here, oh well, most of them are my standard and if they can understand wat the cases are about, wat is going on, i think they will do fine. And laywers will fight to get their points across in layman's term. Any alteration of data, the other side's laywer will keep them in check. Btw, point to ponder, Singapore is one of the few countries that have a law that states all ppl should go to sch. And if u recall, they find it nessesary to get most, if not all of the population armed with an 'o' levels cert. And the level of education here, ppl who are educated and overall IQ of the population here are incidentally, rather high. I read somewhere that even US have ppl who cant read. They can onli speak and recognize train station names by the shapes of the words. Now u noe.

But the point about races in the jury, boy i have to agree on that. Since we all noe that that is a delicate balance we have strive since day one to maintain. Even US, canada, australia are not as racial tolerant as us. We should be pround. We dont have KKK here, hate crimes, or ppl screaming at u simply because of ur color. We are truly racial harmonised. And having a jury system, might topple this balance. Maybe the defendant is a malay, the jury most chinese(since here majority chinese), and the defendant loses. Ppl will say jury racist. True. And i think this is point enuff to keep the jury system here udner wraps.

And about death penalty, maybe it didnt happen often here. Ppl here are usually law abiding(when it comes to serious times) onli locals noe that singaporeans are serious litter bugs. (onli reason why we are so clean and green(as observed by tourists) is because we employ alot of bangadesh(watever that speeling is). explains the india-singapore relationship too.) So ppl dont get hang now and then. But ur point is (InMyHumbleOpinion) rather selfish. U make that muderer sounds like he wants to kill. My onli point is this. He might realise his mistake, and really willing to change. All he needs is a chance. (arent we doing this to all those with criminal records?)So we can counsel him, set him on the rite path. He might kill in the spur of the moment. Ya, i noe, he might kill again, so lets get all the ppl here to learn aikido, defence against this sort of things, keep us all fit, and lower our BMI as well. Kills two birds with one stone. Darn, i am smart!
